Residence Permit

Each foreigner from a “third country” who intends to stay in Germany for longer than three months is asked to have a Residence Permit. To citizens of EU-member states are issued Residence Notification by the foreigners’ authority. In case that there is a visa obligation for the country of origin, it is absolutely compulsory for foreigners who intend to stay in Germany to be in possession of a German visa (“D-Visa”) because this is an indispensable precondition for applying for a Residence Permit in Germany.

By the arrival in Germany it is firstly necessary to register at the Registration Office of the place of residence. In Chemnitz this happens at the Municipal Office. A Registration Card is not only a precondition for applying for a Residence Permit but also f.e. required for opening a bank account at a German credit institution.

Your main contact concerning all immigration issues is the local foreigners’ authority. This is the place where you file your application for Residence Permit. Please make an appointment with the responsible advisor. You will then receive the application form and information concerning the necessary documents.

Normally the foreigners’ authority hands out the Residence Permit on the occasion of a personal appearance of the applicant. Important note: The Residence Permit is only valid for the purpose of stay you applied for (studies or participation at a language course, employment, family unification). In case the purpose of stay changes, it is absolutely indispensable to file a new application because the issued Residence Permit possibly becomes invalid and in this case there might be the criminal offence of illegal residence in Germany. If it is intended to take up an employment, it has to be checked if this is explicitly allowed by the stipulations of the Residence Permit.
